Terms and Conditions

Scope of Application

These General Terms and Conditions apply to all orders placed by consumers through the online shop of Beq Art, Bergerstr. 94, 53879 Euskirchen, E-mail: beq_art@hotmail.com. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the "Buy Now" button, the customer places a binding order. The purchase contract is concluded when the customer receives an order confirmation by e-mail.

Prices and Shipping Costs

All prices quoted are final prices. In accordance with §19 para. 1 UStG (small business regulation), no sales tax is levied and therefore not shown. In addition to the purchase price, shipping costs of €4.99 apply within Germany. Further information can be found under "Shipping & Delivery".

Payment

Payment is made before delivery via the payment methods offered at checkout, in particular PayPal, credit card, Shopify Payments (including Apple Pay and Google Pay), Klarna (if available), and Shop Pay.

Delivery

Delivery is exclusively within Germany to the delivery address provided by the customer. Should delivery become impossible due to force majeure (e.g., natural disasters, war, or strike), the delivery obligation ceases. Payments already made will be refunded immediately in this case.

Retention of Title

The goods remain the property of Beq Art until full payment has been received.

Liability for Defects (Warranty)

The statutory warranty rights apply. In the case of justified defects, the customer may choose between repair or replacement delivery. There is no warranty claim for damages caused by improper handling or external influences. The warranty period is two years from the delivery of the goods.

Liability

Beq Art is liable without limitation for intent and gross negligence as well as for injury to life, limb or health. In cases of slight negligence, Beq Art is only liable for the breach of essential contractual obligations and limited to foreseeable damage. Any further liability is excluded.

Right of Withdrawal

Consumers generally have a right of withdrawal according to the separate cancellation policy. There is no right of withdrawal for goods that are custom-made, signed, numbered, or produced to order (§312g para. 2 no. 1 BGB).

Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Place of Jurisdiction

If the customer is a merchant or does not have a residence in Germany, the place of jurisdiction is Euskirchen.

Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which can be found at https://ec.europa.eu/consumers/odr/. Beq Art is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Final Provisions

Should individual provisions of these General Terms and Conditions be or become wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected.
